Alarming Trend: Kids Are Taught By Teachers Without Credentials

Teaching without the proper credentials is a problem in America.

This is especially true in California, according to new data reported initially by California Watch. The state Commission on Teacher Credentialing?s data showed that from 2007 to 2011, 1 in 10 teachers or certificated personnel didn?t have credentials or authorization for their positions, or about 32,000 school employees.

What does that mean exactly? Teachers who are qualified for biology may have been teaching history. Or English teachers may have been teaching math. In some cases, unqualified teachers teach special needs classes.

While this is a problem now, according to Anne L. Padilla, a consultant with the California Commission on Teacher Credentialing, it used to be worse.

?As the California Watch article points out,? Padilla told TakePart in an email, ?the number of misassignments has dropped dramatically since the 2005-06 school year; from 29 percent to 12 percent when the state began giving greater attention to teacher assignments at low-performing schools. The Commission continues to work with COEs to decrease the number of misassignments in their schools.?

According to Padilla, ?misassignment? is the placement of a certified employee in a teaching or services position for which the employee does not hold an appropriate authorization for the assignment.

The reasons for misassignment varies, according to the report, which states ?staffing turnover and shortages, insufficient resources, poor planning and mismanagement contribute to assigning teachers to classes for which they lack specialized training.?

When this happens, it is the students who suffer.

Teachers need knowledge of the content to create engaging, authentic and academically rigorous learning opportunities.

?It seems reasonable to assume that teachers need knowledge of the content to create engaging, authentic and academically rigorous learning opportunities for students,? Steve D'Agustino, director of Fordham University?s Regional Educational Technology Center told TakePart. ?It's unlikely that a teacher who may be one or two chapters ahead of the students can help them meet the challenges of an increasingly competitive and complex global society.?

California, however, is far from alone with dealing with the misassignment problem.

The National Education Association has reported that ?each year some out-of-field teaching takes place in more than half of all U.S. secondary schools, and each year over one fifth of the public 7th-12th grade teaching force engages in this practice.?

In 2008, The Education Trust reported that low-income students and minority students are about ?twice as likely as other students to be enrolled in core academic classes taught by out-of-field teachers.?

In 2011, the National Center for Education Statistics (NCES) reported that about 30 percent of chemistry and physics teachers in public high schools didn?t major in these fields and didn?t have a certificate to teach the subjects. These are the subjects President Barack Obama has deemed critical to America?s future in a global economy.

In some cases, misassignments may actually be a misnomer.

?Imagine a school district that cannot identify a licensed algebra teacher but they have a science teacher who has some mathematics expertise,? D'Agustino told TakePart. ?Not offering algebra is not an option so they often have no choice but to place the science teacher in that class until a certified teacher can be identified.?

He says to imagine teaching as a competitive market like any other business. In that way, licensed teachers in any subject?math, science, English?is a competitive game.

?So it may be that math teachers can pick and choose where to teach and as a result may elect to teach in more ?desirable? districts?better paying, higher performing,? he said. ?This results in a lack of certified teachers in under-performing areas, exacerbating the poor performance in mathematics.?

Solutions to this problem are controversial and complex.

?Districts cannot pay math teachers more than physical education teachers (for example) even though math teachers might be in greater demand,? he said. ?All teachers, regardless of subject area, are on the same salary scale.?

He suggests that perhaps schools should adopt the university model and use adjuncts as universities do. But that comes with a problem as there are no real mechanisms that allow most schools in the United States this option.

Still, an unqualified teacher in a certain subject is better than no teacher at all.

?This is not to suggest that these misassigned teachers (and the schools for which they work) are operating in bad faith,? D'Agustino adds. ?Rather, they present the best solution to a persistent teacher shortage.?

NEC NP-VE281


Although the NP-VE281 from NEC Display Solutions of America is a decidedly no-frills model, what this inexpensive portable data projector for use in business or school presentations lacks in bells and whistles it makes for in solid data and video image quality and an easily audible sound system.

The NP-VE281 is an off-white projector with rounded corners. It measures 3.2 by 10.9 by 9.7 inches (HWD) and weighs 5.1 pounds, so it's lightweight and quite portable. It lacks a carrying case?a suitable one is available from NEC for $54 (direct). ?

This projector has a native SVGA (800 by 600) resolution, a 4:3 aspect ratio typical of traditional data projectors. It's rated at a fairly bright 2,800 ANSI lumens.

The NP-VE281 has focus and zoom rings behind the lens. At maximum zoom (a mere 1.1:1), it projected an image that filled our test screen, about 50 inches diagonal, from nine feet away, a little farther than usual for a long-throw data projector.

This projector's sparse selection of ports include VGA-in; HDMI; a video-in RCA jack; audio-in, and RS-232. The absence of a port to run presentations off a USB thumb drive means you'll have to lug a computer or other data source with you when you take the NP-VE281 with you on the road.

Data Image Testing
In my testing using the DisplayMate suite, the NP-VE281's image quality was very good for a budget DLP projector, and fine for typical business or classroom presentations. In our type tests, text was readable down to our smallest test sizes, though the small white-on-black type was a little bit blurred. Generally, color was good; some white areas against dark backgrounds showed mild yellow tinting; while yellow swatches appeared a bit mustardy.

The NP-VE281's data images showed traces of the rainbow effect. In this phenomenon, which is exclusive to DLP-based projectors, light areas against dark backgrounds may break down into their component colors to form rainbow glints. People vary in their sensitivity to this effect (I seem to be of average sensitivity). The rainbow effect for this model was typical of today?s DLP projectors, and shouldn't be an issue with data images for the vast majority of viewers.

Video Testing
Video quality was solid for a budget portable DLP projector. There was occasional posterization (abrupt shifts in color where they should be gradual), as well as faint hatching in some backgrounds. The rainbow effect was visible in some scenes that tend to draw it out. It could be a distraction to viewers who are particularly sensitive to it, but shouldn't bother most users. Although I wouldn't want to watch full-length movies with it, the video quality should be fine for short to mid-length clips to accompany a presentation.

Other Issues
To complement the solid video quality, audio from the NP-VE281's 7-watt speaker proved a bright spot, loud enough to fill a small to mid-sized room, and of decent quality. Users shouldn't miss the absence of an audio-out jack to connect to external speakers.?

The NP-VE281 is a barebones data projector, with very good data image and solid video quality for an SVGA projector, and reasonably loud sound. It's a good choice for a businessperson who needs to present on the road to small groups, or a teacher for the occasional classroom presentation. Although small and light enough to be portable, it lacks a carrying case, though one can be bought from NEC. It has a sparse set of connectivity ports, and lacks the ability to run presentations from a USB thumb drive.

The Editors' Choice Epson PowerLite 93+ provides higher (XGA) native resolution at the same 4:3 aspect ratio as the NP-VE281. The 93+ costs and weighs a bit more than the NEC projector, but provides superb data and video image quality, and as an LCD projector it's guaranteed to be free of rainbow artifacts. Its audio is even louder than that of the NP-VE281. The Epson PowerLite S11 Multimedia Projector is an LCD-based SVGA projector with a good feature set and solid data image quality, though it lacks an HDMI port.

Although the NEC NP-VE281 is low resolution and limited in features, this inexpensive data projector delivers where it counts, generating good data image quality, solid video, and fairly loud audio. For many educators and road warriors, that should be more than enough.

Colo. kids stranded at school overnight by snow

DENVER (AP) ? A snowstorm moving across the Midwest forced about 60 students to spend the night at their Colorado school when a state highway was closed due to dangerous conditions that left some drivers stranded in their cars, as winter weather continued to cause problems for a wide swath of the country.

Tens of thousands remained without power in Michigan, while adverse conditions continued to disrupt flights at Chicago's O'Hare Airport. In eastern Wisconsin, hundreds of vehicles were stranded or ended up in crashes as a winter storm made travel dangerous. And in Kansas, the latest snowstorm to hit the state was being blamed for six deaths.

According to the air traffic tracking website FlightAware.com, about 100 flights in and out of Chicago's airports have been canceled for Wednesday. Flights into O'Hare International Airport are being delayed an average of about an hour.

On the plains in the eastern half of Colorado, wind and snow created whiteout conditions Tuesday afternoon just as buses began taking students home from the Miami-Yoder school district school about 40 miles east of Colorado Springs. The buses turned back to the school and about 60 students, ranging from preschoolers to 12th graders, watched movies, played basketball, ate concession-stand pizza and talked to their parents before bedtime.

The older kids slept on wrestling and gym mats covered with coats, while the younger ones curled up on preschool napping mats, Principal Sharon Webb said.

The school is a large version of a one-room schoolhouse. The students all know each other, and many are related, which Webb said gave it the feel of a sleepover. She said parents were understanding.

"When you live out here in this wide-open country, you know they're where it's the safest," she said of the school.

Daylight showed how powerful the wind had been. Outside, there were drifts up to 4 feet high, but the grass was still visible on the football field.

The blowing snow also temporarily closed a 150-mile stretch of Interstate 70 from just outside Denver to the Kansas line, along with other smaller highways in eastern Colorado, including the one leading to the school. Deputies in surrounding El Paso County responded to about 40 calls for help from stranded drivers or reports of vehicles off the road that might still have people inside. No injuries were reported.

Kansas Gov. Sam Brownback said Wednesday the latest winter storm to hit his state caused six deaths.

The governor said two people died in traffic crashes, two siblings died from carbon monoxide poisoning in Kansas City, Kan., a woman died in southwest Kansas while shoveling snow, and another Kansas City resident was killed while walking in the snow.

The storms that crossed Kansas last Thursday and again this week dropped more than 2 feet of snow in some places and knocked out power to thousands of customers, mostly in eastern counties.

In Michigan, utilities said Wednesday roughly 50,600 homes and businesses lost electrical service after a storm that hit the state starting Tuesday knocked down power lines and tree branches.

Detroit-based DTE Energy Co. said about 40,000 of its customers were without power in the morning, and that Washtenaw County was the hardest hit.

Consumers Energy reported about 10,600 of its customers were without power in Wednesday afternoon. The subsidiary of Jackson-based CMS Energy Corp. said those outages include about 2,624 customers in Jackson County and 2,086 in Calhoun County.

The utilities said crews would work around the clock to restore power.

The National Weather Service said 9 inches of snow were reported in Muskegon, Mich., as of Wednesday morning. Authorities said weather might be a factor in crashes that killed motorists in Sanilac and Monroe counties.

In Wisconsin, there were more than 340 stranded vehicles and crashes in Milwaukee, Kenosha, Ozaukee and Washington counties after heavy snowfall that started Tuesday and continued into Wednesday.

The storm dumped 14 inches in Sheboygan County, where sheriff's Lt. Mark Rupnik said they've had at least 100 calls for stranded vehicles, vehicles in ditches or accidents. He said the main highways were drivable as of Wednesday afternoon but expected the secondary roads to be a problem for the next day.

Several area school districts canceled classes Wednesday, and there were power outages in the Milwaukee area.

Elsewhere, authorities said no one was injured after a train collided with a car that was stuck in snow on railroad tracks in Woodward, Okla., where at least 15 inches of snow fell.

The car's driver tried to drive over the train tracks Wednesday morning but became trapped on the snow-covered road, Oklahoma City television station KWTV reported.

Authorities say the driver was able to exit the car safely but couldn't push the vehicle from the tracks before the train smashed into it. The car was totaled in the collision.

(AP) ? Paul Pierce scored 26 points, including seven straight in overtime, and the Boston Celtics beat the Utah Jazz 110-107 on Monday night to close out a five-game road trip.

Pierce had a chance to win it in regulation, but his 19-footer at the buzzer rimmed out.

Alec Burks' reverse layup pulled Utah to 108-105 with 37 seconds left in overtime. Kevin Garnett's banked 3-pointer with 13 seconds left came after the shot clock expired, giving the Jazz another chance.

Paul Millsap was fouled before he could get off a 3, but made two free throws with 4.2 seconds remaining.

Courtney Lee added two free throws at the other end with 1.2 seconds left to bump Boston's lead back to three, and Randy Foye's 26-footer at the buzzer missed everything.

Avery Bradley added a season-high 18 points for Boston.

Gordon Hayward led Utah with 26 points, Millsap had 16 and Al Jefferson finished with 15 points and 11 rebounds.

The Celtics (30-27) were playing their fifth game in seven days, but didn't seem to care down the stretch.

The Jazz (31-25) led 101-99 in overtime on DeMarre Carroll's 21-footer, but Pierce countered with a 3-pointer, then followed with a pull-up jumper over Carroll and a 15-footer to give the Celtics a 106-101 edge with 1:12 left.

Jefferson hit a 15-footer with 1:05 left to get Utah within 106-103, but Garnett's jumper over Jefferson helped seal it.

The Celtics also were smart down the stretch, fouling with fouls to give and finding a wide-open Lee when the Jazz needed a late steal in overtime.

The Jazz trailed by eight entering the fourth but opened on a 13-2 run.

Jefferson's 10-foot turnaround jumper over Brandon Bass tied it at 93 with 2:46 left in regulation.

Pierce hit an 18-footer with Carroll diving at him for a 97-95 Boston lead with 36 seconds remaining in regulation, only to see Burks tie it with a tough layup with 19 seconds left.

The game took a 16-point swing in the third, as Boston trailed 58-50 only to counter with a 20-4 run and lead 80-72 entering the fourth.

Pierce ignited the run with a 3-pointer, Bradley hit two more 3s and Lee added a dunk after a steal and another 3-pointer. Pierce capped the run with a jumper over Hayward for a 70-62 Boston lead.

The Celtics hit 6 of 13 3-pointers in the quarter, while Utah made just 5 of 16 from the field.

Utah trailed 34-27 after Jason Terry's 3-pointer with 10:49 left in the second but went on a 17-2 run to lead 44-36 with 5:46 left in the quarter.

Utah led 53-48 at halftime.

The Celtics led 28-26 after the first in a quarter that saw seven lead changes and seven ties. Overall, the game had 13 lead changes and was tied 17 times.

NOTES; Jazz coach Tyrone Corbin opted to start Earl Watson over Jamaal Tinsley at point for a faster pace, but Burks ended up playing much of the game there. ... Jazz F Derrick Favors picked up his third foul with 9:06 left in the second quarter. . Jazz G Foye needed four 3-pointers to tie Mehmet Okur (129, 2006-07) for the franchise single-season record. Foye went 0-5 Saturday but hit his first Monday and finished 2 of 6 . . Bradley started 5 of 5 and had 10 points in six minutes for Boston, while Millsap started 4 of 4 for Utah.

Hands-on with the Lenovo K900

At CES in January Lenovo unveiled the K900, a high-end, big-screen smartphone aimed at the Chinese market. And at Mobile World Congress this week, the manufacturer gave us a closer look at this dual-core, Intel-powered beast.

At 5.5 inches diagonally, the K900 dwarfs even the Galaxy Note 2, and like other devices in this half phone space, half tablet it's easy to see how this might not be ideal for every smartphone buyer.  But the overall design is attractive enough, with a metallic chassis and squared-off edges. On the front is a 1080p display, which looks about as sharp and clear as you'd expect. On the inside, Intel's Clovertrail+ -- a dual-core, HyperThreaded CPU -- provides enough horsepower to keep things running smoothly, and around the back is a 13MP Sony Exmor R camera with f/1.8 aperture. On the hardware side, we came away pretty impressed.

The K900 is running Android 4.2 Jelly Bean, along with Lenovo's own software layer software, and although it's great to see 4.2 finally rolling out to devices, the manufacturer's UI customizations leave something to be desired. Visual gimmicks such as a rotating cylindrical app drawer persist, and the sleek minimalism of stock Android has been replaced by cartoonish buttons and a lack of overall visual cohesion.

Lenovo is a relative newcomer to the smartphone market, and like many in the early days, they're doing better in terms of hardware than they are software. Nevertheless, our brief time with the K900 has our interest piqued, and we'll be keeping a watchful eye on what's next from the manufacturer.

Connecting the (quantum) dots: First viable high-speed quantum computer moves closer

Feb. 26, 2013 ? Recent research offers a new spin on using nanoscale semiconductor structures to build faster computers and electronics. Literally.

University of Pittsburgh and Delft University of Technology researchers reveal in the Feb. 17 online issue of Nature Nanotechnology a new method that better preserves the units necessary to power lightning-fast electronics, known as qubits (pronounced CUE-bits). Hole spins, rather than electron spins, can keep quantum bits in the same physical state up to 10 times longer than before, the report finds.

"Previously, our group and others have used electron spins, but the problem was that they interacted with spins of nuclei, and therefore it was difficult to preserve the alignment and control of electron spins," said Sergey Frolov, assistant professor in the Department of Physics and Astronomy within Pitt's Kenneth P. Dietrich School of Arts and Sciences, who did the work as a postdoctoral fellow at Delft University of Technology in the Netherlands.

Whereas normal computing bits hold mathematical values of zero or one, quantum bits live in a hazy superposition of both states. It is this quality, said Frolov, which allows them to perform multiple calculations at once, offering exponential speed over classical computers. However, maintaining the qubit's state long enough to perform computation remains a long-standing challenge for physicists.

"To create a viable quantum computer, the demonstration of long-lived quantum bits, or qubits, is necessary," said Frolov. "With our work, we have gotten one step closer."

The holes within hole spins, Frolov explained, are literally empty spaces left when electrons are taken out. Using extremely thin filaments called InSb (indium antimonide) nanowires, the researchers created a transistor-like device that could transform the electrons into holes. They then precisely placed one hole in a nanoscale box called "a quantum dot" and controlled the spin of that hole using electric fields. This approach -- featuring nanoscale size and a higher density of devices on an electronic chip -- is far more advantageous than magnetic control, which has been typically employed until now, said Frolov.

"Our research shows that holes, or empty spaces, can make better spin qubits than electrons for future quantum computers."

"Spins are the smallest magnets in our universe. Our vision for a quantum computer is to connect thousands of spins, and now we know how to control a single spin," said Frolov. "In the future, we'd like to scale up this concept to include multiple qubits."

Severance agreements: Beware new legal risks ? Business ...

If your severance packages to departing workers include a waiver of future potential lawsuits, that?s a smart strategy. But be aware that small mistakes with severance packages?especially for older workers?can lead to big problems in court. Here are two recent lessons learned in the courts:

Lesson 1: Give employees time

Following a dispute with a lab technician, Columbia University in New York offered a deal: The worker would resign in exchange for a small severance payment and compensation for unused vacation leave.

The university gave him an hour to consider the offer, which had been negotiated with the help of a local union rep. The employee accepted the terms, but later regretted signing. He sued, saying he?d signed the severance under duress. The court let the case go to trial, noting the short time and the fact that he didn?t have access to an attorney. (Mandavia v. Columbia University)

Note: To comply with age bias laws, you should give employees at least 21 days to consider severance packages that include waivers of age discrimination lawsuits.?

Lesson 2: Sweeten the deal

Another requirement for severance waivers of age discrimination claims: They?re only valid if the agreement gives the departing worker more money (or some other benefit) than they would otherwise receive if they didn?t sign the deal.

That?s why any severance packages must be crystal clear about the basis of extra payments?and what the employee would get if he or she didn?t sign. ?

Example: When Charles was laid off from Motorola, he signed a severance agreement that gave him $80,000 in exchange for promising not to sue. He sued anyway, arguing that it wasn?t clear whether he would have received the same amount even if he didn?t sign the lawsuit waiver.

The court said the case could go forward. Motorola will have to show how the payment compares to what Charles would have received if he didn?t sign. (Lamberti v. Motorola Solutions)

Final tip: Severance agreements aren?t do-it-yourself projects. Get your attorney?s help, especially if the employees involved are over age 40.

Age discrimination: 6 parts of a legal severance waiver

Severance packages must conform to the Age Discrimination in Em??ploy??ment Act (ADEA) and its companion law, the Older Workers Ben??efit Protection Act (OWBPA). Together, the laws dictate how you can legally ask employees to waive their rights to sue. When asking employees to waive their rights to age discrimination lawsuits, the waiver must:

  1. Be in writing and be understandable.
  2. Specifically refer to the ADEA rights or claims.
  3. Not waive rights or claims that may arise in the future.
  4. Be provided in exchange for other consideration.
  5. Advise the person in writing to consult an attorney before signing.
  6. Provide the person at least 21 days to consider the agreement and at least seven days to revoke the agreement after signing it.

Doing good is good for you: Volunteer adolescents enjoy healthier hearts

Feb. 25, 2013 ? Giving back through volunteering is good for your heart, even at a young age, according to University of British Columbia researchers.

For their study, published February 25 in the journal JAMA Pediatrics, researchers from UBC's Faculty of Education and Department of Psychology wanted to find out how volunteering might impact physical health among adolescents.

"It was encouraging to see how a social intervention to support members of the community also improved the health of adolescents," says Hannah Schreier, who conducted this research during her doctoral studies at UBC.

Researchers split 106 Grade 10 students from an urban, inner-city Vancouver high school into two groups -- a group that volunteered regularly for 10 weeks and a group that was wait-listed for volunteer activities. The researchers measured the students' body mass index (BMI), inflammation and cholesterol levels before and after the study. They also assessed the students' self-esteem, mental health, mood, and empathy.

The volunteer group of students spent one hour per week working with elementary school children in after-school programs in their neighborhood. After 10 weeks they had lower levels of inflammation and cholesterol and lower BMIs than the students who were wait-listed.

"The volunteers who reported the greatest increases in empathy, altruistic behaviour and mental health were the ones who also saw the greatest improvements in their cardiovascular health," says Schreier, now a postdoctoral fellow at the Icahn School of Medicine at Mount Sinai in New York.

Cardiovascular disease is one of the leading causes of mortality in Canada and the United States. The first signs of the disease can begin to appear during adolescence. Previous studies show that psychosocial factors, such as stress, depression and wellbeing, play a role in the disease.

It has been a week since an accident on Interstate 80-35 pinned a car under a semi.

Now the family of the driver, Tara Lietzinger, is trying to figure out a way to pay for her hospital expenses but legal issues are standing in the way.

Tara Lietzinger?s family and friends never imagined something like this would happen, ?With brain injuries it?s just waiting, there?s no bench mark,? said family friend Chris Lappe.

A car and semi crash left Tara in a coma and in critical condition at Iowa Methodist.

Doctors say, only time will tell how long it takes for the Johnston resident to recover. While the family waits, there are other things that need to be taken care of.

?There are a lot of legal proceedings that need to be done and it takes time. Court papers need to be filed to get the ball rolling so it does take some time.?

Everything is in Tara?s name; bank accounts, bills and insurance and since Tara can?t speak for herself, they have to hire an attorney and that costs money, ?We?re looking for some donations to get the ball rolling on that.?

Lappe hopes to raise $4,000 to pay for an attorney. He began accepting donations less than 24 hours ago and has already raised more than $800.

?Her mom needs some help getting it done and that?s why we?re looking for some donations so we can get the ball rolling real quick and get it taken care of for Tara.?

Without the power of attorney, they can?t access anything of Tara?s, ?There?s just all these steps you have to go through and think about that takes a lot of time and effort.?

Steps the police are also having to go through. Investigators are missing relevant information, such as the cause of crash. They can?t access that information because of Tara?s condition.

Lappe say the accident has him thinking differently as to what he would do if something happened to him, ?Yeah, ?it?s definitely not a bad idea to make sure you have a close family member who is able to give them access to your passwords, your bank accounts so they can at least go online. ?

One way to avoid this happening to you is planning ahead for unexpected situations with living wills to make things a little easier for family during difficult times.

Net providers begin warning of illegal downloads

Internet users who illegally share music, movies or television shows online could soon receive warning notices from the nation's five major Internet service providers.

The Copyright Alert System, organized by the recording and film industry, is being activated this week to target consumers using peer-to-peer software.

Under the new system, complaints will prompt an Internet service provider ? such as Verizon or AT&T ? to notify a customer whose Internet address has been detected sharing files illegally. A person will be given up to six opportunities to stop before the Internet provider will take more drastic steps, such as temporarily slowing their connection, or redirecting Internet traffic until they acknowledge they received a notice or review educational materials about copyright law.

Consumers who maintain they have been wrongly accused would be forced to pay $35 to appeal the decision. The fee would be reimbursed if they prevail.

Proponents say the focus is on deterring the average consumer rather than chronic violators. The director of the organization behind the system, Jill Lesser of the Center for Copyright Infringement, said in a blog post Monday that the program is "meant to educate rather than punish, and direct (users) to legal alternatives."

Each Internet provider is expected to implement their own system. The other providers expected to participate are Cablevision, Time Warner Cable and Comcast. (NBC News is part of NBCUniversal, which is owned by Comcast, a provider of cable TV and broadband Internet access.)

The program gives each customer five or six "strikes" after a music or film company has detected illegal file-sharing and lodged a complaint. The first alerts are expected to be educational, while the third and fourth would require the customer to acknowledge that they have received the warnings and understand their behavior is illegal. The final warnings are expected to lead to "mitigation measures," such as slowing a person's Internet connection speeds.

Officials involved in the effort acknowledge it's unlikely to stop the biggest violators. There are ways to disguise an IP address or use a neighbor's connection that is unlocked. Public wireless connections, such as those offered at coffee shops, also won't be monitored.

Survey: Most Developers Now Prefer HTML5 For Cross-Platform Development

HTML5_vs._Hybrid_vs._NativeAccording to a new survey commissioned by Telerik’s Kendo UI, the majority of developers now prefer to work with HTML5 instead of native apps for their cross-platform development. Half of the 5,000 developers surveyed in the company’s 2013 Global Developer Survey also said that they developed apps using HTML5 in 2012 and 90% of them plan to do so in 2013. Only 15% of developers said they would prefer to use a native-only approach. The idea behind the survey, Kendo UI’s VP of the company’s HTML5 web and mobile division Todd Anglin told me last week, was to understand how developers are working with HTML5 and what kinds of apps they are developing. The company, however, also looked at the larger HTML5 ecosystem and found, for example, that most developers said they were interested in developing for Windows 8 (66%) – something Microsoft will likely be happy to hear – and ChromeOS (47%), but weren’t all that interested in Blackberry 10 (13%) and Tizen (8%). It’s worth noting that this preference doesn’t always result in actual products getting shipped. Many of these developers are probably working for larger corporations that don’t give them the flexibility to develop in the languages they would like to. Kendo UI surveyed about 5,000 developers from around the world for this survey over the course of January 2013. Most of the developers worked for small and medium businesses (51%) , 29% worked for startups and 20% for enterprises. Given that these developers were likely already interested in HTML5 before they took the survey, chances are the results are somewhat biased toward HTML5. Interestingly, the developers surveyed by Kendo UI also said that Blackberry and iOS are the most?difficult?platforms to develop for. Windows 8 and Windows Phone 8 ranked as the easiest with Android falling in the middle. As Anglin noted, the reason for this could be the fact that developers can use HTML5 to write apps for the Windows platforms, but also that Microsoft provides a very robust set of tools for its developer ecosystem. As for the kinds of HTML5 apps developers are working on, the survey found a clear emphasis on productivity apps (54%) and utilities (38%). Entertainment, lifestyle, travel apps and games ranked at the bottom of the list. Whether you are an admirer of 7 or 8 inch tablet devices, or don't really care about these particular screen sizes, the leading mobile gear makers decided that there is a market niche to be won here, and with the introduction of the Samsung Galaxy Note 8.0 everyone will have a dog in the small tablet fight this season.We are pitting Samsung's latest Note family member against its most formidable opponents - the Apple iPad mini and the Google Nexus 7?small affordable slates. Moreover, Samsung's tablet is the best of the bunch memorywise, sporting 2 GB of RAM and 16 GB of internal memory, as well as a microSD slot for more, which the other two don't have.

When we add the generous 4, 600 mAh battery and the myriad of productivity options added by the S Pen stylus and the accompanying software, it seems that Samsung has nailed it in terms of specs as usual, so the only thing remaining is to get one for a review to check out the performance side as well.

Three Missouri Democrats signed on to a bill that would make it illegal for state legislators to even suggest laws limiting unions? collective bargaining powers.

The legislation was sponsored by Rep. Jeff Roorda. According to the text of the bill, any legislator who proposes restrictions on collective bargaining will be subject to prosecution for a class D felony.

?Any member of the general assembly who proposes a piece of legislation that further restricts the right of an individual to bargain collectively, as set forth under section 29, article I of the Missouri Constitution, shall be guilty of a class D felony,? reads the text of the bill.

The legislation would prevent state congressmen from proposing laws such as right-to-work, a popular labor policy reform that gives individual workers the right not to join unions. Michigan recently became the 24th?right-to-work state in the nation. Missouri does not have right-to-work.

Roorda?s office did not immediately respond to requests for comment. His bill likely came in response to one proposed by Republican Rep. Mike Leara, which would similarly criminalize any efforts by legislators to restrict gun ownership.

biggest percentage for the nine-month period on record,

according to Thomson Reuters data going back to 2002. Full-year

data for 2012 was not yet available.

A severe labour shortage is hobbling businesses in Singapore

as the government tightens its immigration policies, while

growth has been hard to come by as exports languish in a dull

global economy.

Across Southeast Asia, 54 percent of companies reported

shrinking margins, equalling the percentage recorded in 2009,

when the global economy had tipped into a recession following

the Lehman Brothers bankruptcy.

In all, Reuters examined the balance sheets of nearly 1,000

companies in Singapore, Malaysia, Indonesia, Thailand and the

Philippines with a market value of at least S$100 million ($80.8

million).

The pain is particularly acute in Singapore, a smaller and

more mature market lacking the burgeoning consumer classes of

its emerging market neighbours. Inflation has heated up, with

the consumer price index, due on Monday, expected to show a 4.0

percent rise in January, according to a Reuters poll.

The head of a Singapore business association is among those

moving their corporate headquarters elsewhere, in search of

lower costs and a larger market.

Chan Chong Beng, head of the Association of Small and Medium

Enterprises in Singapore and chairman of Goodrich Global, a

carpet and wallcoverings company with a presence in eight

countries, said he planned to move his firm's headquarters and

operations such as product development to Wujiang, China, near

Shanghai. Sales and marketing will stay in Singapore, he said.

"Businesses today face a very awkward situation," Chan said.

"The worst is we can't find the workers."

"Potentially there's a lot of room to grow in China. Over

here, no matter how much I can push, there's a limit to my

growth," he added.

PACKING UP

Singapore, a major financial and trading centre known for

its business-friendly policies, faces a tightening labour market

as authorities curb the influx of foreign workers, spurred by

public grumbling about overcrowding and soaring property prices.

A survey conducted late last year by the American Chamber of

Commerce in Singapore found 15 percent of respondents - U.S.

businesses which are members of the chamber - were considering

moving operations away, while 5 percent had already done so.

Andrew Tjioe, president of the Restaurant Association of

Singapore which has more than 300 members, said the pressure

from rising costs and a shortage of labour was unprecedented.

"I have gone through so many rounds of recessions - the 1997

recession, SARS and then 2008," said Tjioe, who has been in the

food and beverage industry for three decades. "I can feel the

pressure right now. I believe this has got to be the worst."

At Chan's Goodrich Global, sales growth in Singapore has

been slow in the past two or three years while rents have shot

up around 30 percent and labour costs have risen as much as 20

percent.

Small and medium-sized businesses like Chan's have been

among the hardest hit. These companies collectively contribute

more than half of Singapore's gross domestic product and employ

seven out of every 10 workers.

Last month, the American Chamber of Commerce in Singapore

and eight other business organisations sent a joint letter to

the city state's government highlighting concerns about tighter

limits on foreign workers.

"While Singapore continues to attract significant foreign

investment we nevertheless fear current implementation of

revised labour policy risks negatively impacting Singapore's

economy and reputation as an open economy," the letter said.

Singapore's Economic Development Board has acknowledged the

impact of tighter immigration measures on industry and has taken

steps including helping companies to boost productivity, the

board's managing director Yeoh Keat Chuan said.

Some companies will be reluctant to move completely out of

Singapore, which offers a strong record in safety, regulation

and transparency, although their expansion efforts will likely

focus on neighbouring countries with faster growth.

That expansion can help them to weather some of the

pressures at home.

Electronics and furniture retailer Courts Asia Ltd

, which has 72 stores in Singapore and Malaysia, is

setting up a 140,000 square-foot (13,000 square-metre) megastore

in eastern Jakarta, which will be the group's largest when it

opens in 2014.

"We don't want to discount Singapore in terms of growth

potential," said Courts Asia Chief Executive Terry O'Connor.

"But of course Indonesia and Malaysia have more greenfield

territories, there are more options. We go to Indonesia, we can

be 'big box' from day one."

Singapore bakery and restaurant chain BreadTalk Group Ltd

, which aims to boost revenue to S$1 billion in the

next few years, is expanding regionally - particularly in China

and Thailand - to balance out cost pressures at home.

"In Singapore's retail environment, rising costs are largely

attributed to rent and labour," said BreadTalk Chief Financial

Officer Lawrence Yeo. "In response, we've had to fine tune our

business model."

London hospital builds lullaby factory

Great Ormond Street Hospital for Children in central London, presented architecture practices with a tough brief: how to pretty up a temporary design law. As the winning practice, Studio Weave explains, "The multi-phased redevelopment of Great Ormond Street Hospital, in London's Bloomsbury area, means that the recently completed Morgan Stanley Clinical Building and the 1930s Southwood Building currently sit very close together. The latter is due to be demolished in 15 years, but in the intervening period large windows in the west elevation of the MSCB look directly onto a pipe-ridden brickwork facade, with the gap between the two less than one metre in places."

Rather than smooth away the rough industrial edges, Studio Weave capitalised on the multitude of pipes and vents, re-imagining the space as a "Lullaby Factory", manufacturing and releasing gentle, beautiful lullabies to create a calming and uplifting environment for the young patients to recover in."

The practice then conjured up a plethora of gramophone-style speaker horns, pipes, taps and gauges, incorporating pieces reclaimed from the hospital's old boiler house, which was being decommissioned at the time.

While the lullabies produced by this factory can't be heard blaring around the courtyard, Studio Weave have enabled patients and visitors to hear a specially commissioned lullaby by composer and sound artist Jessica Curry, either by tuning into the hospital's radio frequency, or by putting their ear to a few listening pipes.
