Immigration and Border Security | The Revered Review

Preface

First, let me state clearly and unequivocally that I am in favor of, and support, LEGAL immigration into the U.S.A., for many reasons.

Second, I am opposed to illegal border crossings, and illegal immigration. I believe that in order to prevent these crimes, all borders (including coasts) must be secure, and deterrents must be in place to discourage illegal immigration. Further, total amnesty is not an option. It has been tried at least twice in the recent past, most recently in 1986. It has failed miserably, encouraging further illegal immigration, and leaving us with an estimated 12 million illegal aliens in the U.S. to deal with today. Some individuals and groups have advocated the payment of fines for those who are in the U. S. illegally. This idea would only encourage further illegal immigration at the expense of those who have, or are attempting to, enter this country legally.

Our Progressive politicians want illegal immigrants as they desire to further their agenda of creating an ever bigger government and welfare state.

Amnesty Period

I believe the policies/actions outlined below should be initiated after a six (6) month amnesty period. During this six month amnesty period, every feasible effort will be made to disseminate the new policies. All persons who are in this country illegally will be encouraged to leave voluntarily. Any illegal immigrant who is gainfully employed will be encouraged to obtain a letter from their employer stating their true identity, work history, and rehire status should a position be available when the individual returns to the U.S. legally. This will aid there application for legal immigration.? No person should be prosecuted solely for the crime of illegal immigration during this six-month amnesty period. Any other crime should, of course, be prosecuted, including identity theft.

Border Security

I believe that for a border to be classified as secure, not ONE (1) individual should be able to cross that border illegally. I support the utilization of military forces along the border with explicit orders to USE DEADLY FORCE against ANY individual crossing the border illegally. The U.S. does not need to build a fence. Let our neighbor(s) build a wall to protect their citizens from ricochets! We should use Predator drones and Hellfire missiles to aid in this effort.? The idea would be to have NO deaths or imprisonment because the threat would be a deterrent. I have never had to kill anyone for entering our home illegally, but our neighbors all know that I would do so. Deterrence is the objective, not deaths or imprisonment.

Enforcement

E-Verify should be used by ALL employers in the U.S. In addition verification of citizenship should be required for ALL government services, including, but not limited to: Social Security benefits, Medicare, Medicaid, food stamps, driver?s licenses, school enrollment (both K-12 and higher), etc.? Anyone who assists an illegal alien (granting employment, renting a house, or transporting), would also be guilty of being an accessory to the crime, and prosecuted for that.

Illegal Immigration

After the six month amnesty period, any individual that is apprehended in this country illegally (this would include those who crossed a border illegally and those who came to this country with a legal [student or tourist] Visa, but stayed beyond the Visa period.) should be prosecuted (violating 8 USC Section 1325 (a)(1), a law that makes it a criminal offense for an alien to enter or attempt to enter the United States at a place other than designated by immigration officers.) as follows:

1st Offense ? Two years prison. The sentence will be suspended with the conditions that: A, the individual plead guilty to this crime; B, the individual accepts deportation with their ability to legally enter the U.S subject to both serving this prison sentence, and being placed at the bottom of the eligibility list. (This would all but eliminate them from being able to enter the U.S. again.) Should these conditions not be met, we should move to second offense penalties.

2nd Offense ? Five years prison. For an individual who had their first offense end in a suspended sentence, this would actually mean they would serve a seven (7) year prison term since they would serve time for both the first and second offenses.

3rd Offense ? 20 years prison.

4th Offense ? 50 years prison

Minor Children

Children under the age of 18 years old (or the age of majority in their native country, whichever is less) would not be prosecuted for the crime of illegal entry, PROVIDED, that they came to this country with their parents. However, if they entered the country on their own, they would be prosecuted as an adult, with the same penalties. Instead, the parent who brought the child into the U.S. would serve the additional time for the child. If both parents brought the child into the U.S. illegally, they should each serve 50% of the additional sentence.

Minor children that are U.S. citizens with parents who are illegal aliens may remain in the U.S. or may be returned with their parents to their native country. Should they stay in the U.S. they should be placed for adoption, with the parental rights of the natural parents terminated.

Imprisonment

All individuals imprisoned as illegal aliens should not be allowed to remain in U. S. prisons. These inmates should serve time in a foreign prison, but NOT in their originating country. Inmate prison sentences should be auctioned off, and sold to the country with the lowest bid for each group of prison sentences. This bidding process would only be open to those countries that owe a debt to the U.S.A., as the country would not have to outlay cash, but have the amount deducted from the debt owed to the U.S.

Economic Considerations

All costs of enforcement, food, medical care, and incarceration should be allocated individually, with each originating/native country of perpetrators being billed annually. Failure to pay the demand for this payment will result in an international lawsuit with the appropriate seizure of assets.

Legal Immigration

The U.S. should expand its? legal immigration quotas. We should also establish a process to auction some immigration Visas, thus ensuring that those most likely to contribute to this country will be allowed to enter. Additionally we should establish a temporary work visa program so that individuals can enter this country legally to work in agriculture and other areas, provided the U.S. citizens are not available for this work.? English shall be made the official language of the U.S.A.

Birthright Citizenship

The 14th Amendment should be amended to exclude children of illegal immigrants and visitors from U. S. citizenship.

Does agriculture secretary?s memo on GOP budget violate Hatch Act?

Questions are being raised after Agriculture Secretary Tom Vilsack sent a politically tinged internal memo to employees last week. ?The memo complains about a House Republican spending plan that cuts the agency?s funding.

?The bottom line is that [the] House budget resolution hits USDA and its programs in a very hard way,? Vilsack, the former Democratic governor of Iowa, wrote in the April 4 memo obtained by The Daily Caller.

Vilsack?s portrayal of the Republican budget to the agency?s employees in a negative light could be troublesome if the memo amounted to campaigning against Republicans. The Hatch Act bans campaign activity by federal employees.

Comparing President Obama?s budget to the GOP spending plan passed in the House, Vilsack wrote, ?The President?s budget included a slight increase for USDA?s discretionary budget that funds our organization and some of our programs.?

The law also prohibits presidential appointees like Vilsack from asking subordinates to engage in campaign activities.

But the Washington Free Beacon, which reported the existence of the email Monday, ?cited?a law professor who said the email raises concerns but isn?t a clear-cut Hatch Act violation because Vilsack did not explicitly ask his employees to support Democrats.

?I would watch these memos,? Hatch Act expert Richard Painter told the publication. ?These memos are probably going to push the envelope more and more.?

In the email sent to ?USDA Employees,? Vilsack explained the reason for the memo by saying, ?I want to keep you advised on budget issues as they unfold.?

The USDA did not respond to a request for comment.

In 2010 Ana Galindo-Marrone, the chief lawyer for the government?s Office of Special Counsel, explained that the ?law says we retain a right to retain our opinions, but we can?t engage in political activity on duty.?

?At the end of the day, what the Hatch Act is intended to do is make sure our advancement in the federal service is based on merit and not political affiliations, and that our provision of services to the public is not done in a partisan way,? she said.

I want to keep you advised on budget issues as they unfold. In February the President released his 2013 fiscal year budget. The President?s budget included a slight increase for USDA?s discretionary budget that funds our organization and some of our programs. The President?s budget, while more than our budget this year, would still be $3 billion less than our budget for the 2010 fiscal year. Bottom line ?? under the President?s budget things would be tight and we would have to continue on our path of belt tightening. Our efforts under the Blueprint for Stronger Service would continue and allow us to manage the change brought about by tight budgets.

The House of Representatives, prior to their spring recess, approved their budget resolution that begins to set their priorities for the 2013 fiscal year budget. Overall the House took three actions that impact USDA.

First, their budget resolution provided for government wide discretionary spending of $1.028 trillion which is $19 billion below the level previously agreed to with the Senate during the debt ceiling negotiations of last year.

Second, the budget resolution essentially holds defense spending constant, which means that non-defense discretionary spending will bear the brunt of the cuts. OMB estimates that non-defense spending would be cut by $1 trillion over 10 years which would translate into an average cut of 5.4% in the 2013 fiscal year and a 19% cut in 2014 fiscal year levels.

Third, the House budget resolution seeks to avoid the automatic spending cuts required by the budget control act passed as a result of the debt ceiling negotiations. Again, the House held defense steady and shifted the burden of the cuts to non-defense spending. The budget resolution directs the Agriculture committee to reduce the deficit by $8.2 billion in two years, $19.7 over five years, and $33.2 billion over ten years. The Agriculture committee has yet to decide how to reach these levels.

The bottom line is that he House budget resolution hits USDA and its programs in a very hard way. The Senate has yet to indicate the specifics of the budget for next year, although there are indications we will know more by the end of this month.

As I have said on many occasions the budget challenges we face are unprecedented. It is part of the reason why we must build an improved USDA through cultural transformation and our work to improve administrative services as part of the Blueprint for Stronger Service. I am proud of our efforts to date in keeping down travel, supplies, and conference expenses. While the work to find administrative efficiencies and office consolidations required difficult decisions, they allow us to hopefully keep ahead of the process and allow us some freedom to decide how best to deal with cuts. I encourage all of us to aggressively proceed with the Blueprint for Stronger Service effort. It will make the department more efficient and over time more effective. I will continue to keep you advised as the budget discussions unfold.
