RIM finally gets some good news, court rules it can keep using BBM name

Between delays, executive defections and falling market share the news lately hasn't been rosy for RIM, but today it got at least one reprieve as a Federal Court in Canada ruled its use of the acronym BBM did not infringe another company's trademark. The lawsuit was filed last December by BBM Canada, a broadcast industry group that owns a trademark on the name but because they are in different types of businesses the court decided RIMs usage was acceptable. According to The Globe and Mail BBM Canada CEO Jim MacLeod has not decided whether or not to appeal the ruling, but we're sure the folks from Waterloo will take a win for now. It already had to switch the name of its new OS from BBX to BlackBerry 10 after losing a trademark ruling there and more bad news is expected in its next quarterly earnings report.

Antonio Silva sustained a cut in his loss to Cain Velasquez that gushed a whole lot of blood. Much of that blood went into his eyes, so it's not surprising that Silva said he couldn't see a thing in the fight.

Not surprisingly, he received a medical suspension after the bout. He is out of action until July 23, possibly up to November if his nose is broken. Both possibly out of action until November, Velasquez and Jamie Varner received the longest suspensions because of hand issues.

Fever in pregnancy linked to autism

Women who run a high temperature during gestation may double risk of having an autistic child

Spiking a fever in pregnancy may contribute to autism risk in the offspring. Researchers report that women who run a high temperature while pregnant ? and don?t treat it ? appear twice as likely to have a child with autism as women who don?t report any untreated fevers.

Other studies have suggested a link between infectious diseases during gestation and a heightened risk of having a child with an autism spectrum disorder. But the new study didn?t find a specific connection between influenza and the behavioral disorders, the researchers report in an upcoming issue of the Journal of Autism and Developmental Disorders.

?I think this is the largest and most careful study that?s been done on the topic of fever and influenza in autism development,? says Paul Patterson, a developmental neurobiologist at Caltech, who wasn?t part of this study.

Researchers at the University of California, Davis identified 538 children with an autism spectrum disorder, 162 others with developmental delays and 421 who were developing without any apparent problems. The children?s mothers provided health information on their pregnancies. After accounting for differences in race, child?s age, insurance, smoking, mother?s education and residence at the time of birth, the scientists found that women who had suffered an uncontrolled fever during pregnancy were roughly twice as likely to have an autistic child as mothers with no untreated fevers. Fever in gestation was also associated with a more than doubled risk of developmental delays, report the researchers, who recently also linked autism risk with obesity in pregnancy (SN: 5/19/12, p. 16).

??I think pregnancy is the key for autism,? Patterson says. Several other research groups have also zeroed in on gestation as a critical time, he notes.

Inflammation accompanies fever in the body, and inflammatory proteins called cytokines can pass through the placenta into the fetus during pregnancy, says study coauthor Ousseny Zerbo, an epidemiologist at the Kaiser Permanente Northern California Division of Research in Oakland, who worked on the study while at UC Davis. This transfer would pose a risk if it alters brain development in the fetus at a crucial time, he says. ?Elevated pro-inflammatory cytokines [in utero] lead to behavioral problems in animals,? he says.

What?s more, Patterson says, the heat of fever can overactivate neurons, inducing them to fire more and damage fetal brain growth, tests in animals show.?

Patterson cautions that while the new study is better than previous work on fever and autism, much of the data are based on the mothers? memories of events that occurred years earlier. ?Recall bias is always an issue in this area,? he says. ?If you have an autistic child, you?re always searching for why that happened.?

(AP) ? Spain saw its bond yields shoot up again on Friday after the country's economy minister warned that the future of the euro will be determined in the next few weeks and will depend on the stability of Spain and Italy.

The interest rate on 10-year Spanish bonds stood rose 0.13 percentage points to 6.58 percent in early trading. The rate was more than 5.4 percentage points higher than the equivalent German one, which is considered a safe haven for investors.

Economy Minister Luis de Guindos said in a speech Thursday evening that Spain and Europe were at a crossroads as speculation mounts over whether the country will need a bailout. The danger is that Spain's ?1 trillion ($1.24 trillion) economy is far bigger than those of already bailed-out Greece, Ireland and Portugal combined.

Spain's banking sector is laden with soured investments on real estate and the government needs ?19 billion to rescue just one lender, Bankia SA, at a time of recession and crushing unemployment of 24.4 percent.

"I don't know if we are on the edge of a cliff, but we are in a very, very difficult position," de Guindos said Thursday evening in a speech to business leaders in Sitges, a resort town near Barcelona. "The future of the euro is going to play out in the next few weeks in Spain and Italy."

Bond yields ? a measure of investor confidence in a country's debt ? were also very high in Italy, which has big debts and is in recession. Its 10-year bond yield rose to 5.93 percent on Friday on fears that it could be affected by the instability of Spain.

UBS Investment Research said there is no a consensus that the Spanish banking sector in general needs a big recapitalization. It estimated the sector needs between ?80 billion and ?100 billion in new funds.

"The Spanish State should be able to sustain the recapitalization costs without losing control of its finances," UBS analysts said in a note to clients. "We recognize however that financing this intervention in current market conditions will be difficult."

De Guindos supported the recent proposal by the European Commission for a centralized banking authority with the financial capacity to to inject capital directly into troubled banks without having to go through governments first.

He also said Europe needs a regional bank deposit insurance plan like the United States has and a "banking union" to coordinate regulation among countries.

German, however, opposes the idea of a centralized authority that can spend money ? much of which Berlin supplies ? directly on shaky banks.

"We don't see now how such ideas are supposed to help with the short-term management of the current questions," said German Finance Ministry spokesman Johannes Blankenheim. "The fiscal compact is the beginning of the fiscal union and, as a perspective, one can imagine stronger (banking) supervision."

Germany did indicate, however, that it backs the European Commission's proposal to give Spain more time to reduce its deficit. It stood at 8.9 percent of GDP last year, and the goal is to get it down to 5.3 percent by the end of 2012.

Blankenheim noted that Spain has stated its intention of cutting the deficit to 3 percent by next year, "but we also see that, because of unfavorable economic developments, it could be difficult to reach these targets."

"Spain is fulfilling its commitments in the deficit proceedings and so there is no reason to escalate the proceedings against Spain," Blankenheim told reporters in Berlin. "The Spanish government is tackling with determination the necessary reform measures, and the German government is convinced that this determination will be mirrored on the markets."
